Maryland Statute of Limitations

Maryland has a 3 year statute of limitations on all personal injury actions, which usually begins to run from the date of the personal injury incident. In Maryland workers’ compensation cases, however, there is more than one deadline or statute of limitations that requires caution on the part of the injured worker. There is a notice or reporting period in which the Claimant must notify his/her employer of the accident.

Following the given notice, there is then a 2 year statute of limitations on the filing of a claim form. It’s not enough for the injured worker to have a claim number with the insurance company. The worker must still file the correct form with the state, otherwise the claim can be barred for failure to file the correct forms.

The employee and Insurer need not provide the form to the Claimant, or even advise the Claimant of the requirement of filing a formal claim. There’s a five year statute of limitations on reopening a Worker’s Compensation Claim in Maryland.
