Cell Phone Radiation Litigation

Cell Phones Linked to Brain Cancer

Growing research now shows that exposure to cell phone radiation over a period of time can increase the likelihood of developing tumors of the brain and head. The current research indicates that cell phone use is associated with:

  • Glioblastoma
  • Astrocytoma
  • Oligodendroglioma
  • Ependymoma
  • Acoustic Neuroma

Cell phones emit radio frequency radiation (RF) when they transmit signals.  The RF energy or radiation emitted by a cell phone is measured by its Specific Absorption Rate (“SAR”).   The SAR calculates the average amount of cell phone radiation emitted by each model and then absorbed into the human head and brain. Cell phone radiation can affect brain activity and have other serious side effects linked to certain types of cancers.

Factors that determine the amount of cell phone radiation users are exposed to include:

  • The amount of time spent on the phone
  • The age of the person using the phone
  • Whether the user is using speaker mode or a hands free device
  • The strength of the cell phone signal at the time of use
  • The amount of cell phone traffic at the time of use
  • The model of phone used

There are a number of studies that indicate an increased risk of developing tumors of the brain and head associated with long-term cell phone use. For example,in 2011, Swedish researchers conducted a pooled analysis of case-control studies and found an increased risk for gliomas, one malignant brain tumor type, particularly as the usage increased.

Although mobile phones should comply with government safety requirements, a paper published in the Electromagnetic Biology and Medicine Journal on October 17, 2011 found that most testing performed by the researchers in the cell phone industry underestimates actual emissions. Regular cell phone users may be exposed to unsafe levels of cell phone radiation.

In a recent landmark ruling, a Washington, D.C. Superior Court judge who is presiding over the consolidated lawsuit against the telecom industry ruled that experts who met the evidentiary standards can give testimony related to injury, causation and health effects.

Ashcraft & Gerel, LLP is investigating the safety of cell phones and possible lawsuits against the manufacturers of cell phones and cell phone service providers.
