Joseph T. Musso Partner

In his tenure at Ashcraft & Gerel, Joe Musso has focused his practice on helping people harmed by the carelessness, inaction and negligence of others. From the wives and children of coal miners disabled in the notorious 2012 Massey Mine explosion to the families of elderly nursing home residents who have suffered from abuse, Mr. Musso brings to bear all his trials skills and legal insight to help secure settlements and verdicts his clients are rightfully owed.

Mr. Musso’s proudest accomplishments are not just his track record of success in a wide variety of practice areas, but also the fact that his clients see him as a caring, compassionate ally during some of the most difficult times of their lives. Mr. Musso understands that representing victims of tragic circumstances demands empathy, which is why he seeks to hold those responsible for his clients’ pain accountable out of a deep belief in the healing power of justice.

Case Highlights

Mr. Musso’s interest in nursing home malpractice cases began early in his career. As a young attorney fresh out of a Judicial Clerkship, Mr. Musso was tasked by his first professional mentor with establishing a nursing home abuse and neglect practice at his firm.

In one of the first nursing home negligence cases he handled, Mr. Musso represented a 90-year-old woman whose death was tied directly to extreme mistreatment by the staff of a local nursing home. When the nursing home’s insurance company representative heartlessly told Mr. Musso that recovery for the family of the deceased woman would be limited to $100,000 because that’s what a 90-year-old life is worth, Mr. Musso went to work, further fueled by the injustice of that sentiment. In the end, the family of the victim recovered exponentially more than what the representative had so callously estimated. Mr. Musso took with him from this experience a passion to change the way this nation values our most vulnerable population.

Early Years

Mr. Musso began his legal career as a nursing home abuse and neglect attorney. In fact, he formed and led the successful nursing home litigation department of a boutique law firm in Cherry Hill, NJ for 12 years prior to joining Ashcraft & Gerel.

Outside the Courtroom

Mr. Musso’s interest in helping others lead full, healthy lives extends beyond his office and the courtroom. A professionally trained life coach, Mr. Musso has created a course for the families of nursing home and assisted living residents called “The Empowered Caregiver,” which teaches people how to advocate on behalf of their loved ones in residential health care settings and prevent neglect and abuse before it happens.

In his role as an educator about issues of elder abuse, Mr. Musso is a frequent lecturer for the AAJ Nursing Home Litigation Group, the Virginia Academy of Elder Lawyers, and various other elder advocacy organizations.

Somehow, Mr. Musso also manages to compete in triathlons and coach youth sports in his spare time.
